Applicants apprehend arrest in Crime No. 719/2023, registered with Nanded Rural Police Station, Nanded, for offences punishable under sections 307, 354, 323 r/w. 34 of the Indian Penal Code.

FIR is lodged by Nikita Shinde alleging that on 09.10.2023, accused Nitin Keshav Dongre, his three sisters, one cousin sister, his mother and sister-in-law assaulted her as informant went to question him about second marriage. Nitin Dongre assaulted with rod on head. Other accused persons stripped her clothes and assaulted her with fists and kick blows and also inserted chilly powder.

Heard learned advocate for applicants and learned APP for respondents. Perused the investigation papers. 4.

Accused Nitin Dongre was arrested on 09.10.2023 and he is released on bail by this Court vide order dated 15.12.2023.

Injury certificate of informant shows simple injuries suffered by her, prima facie, which can be attributed to Accused No. 1. Considering the gender of applicants and the fact that investigation is on the verge of completion and as applicants have co-operated in the investigation and nothing is to be recovered from applicants, their custodial detention is not necessary in the facts of the present case.

In the result, application is allowed by confirming the interim protection order dated 19th January, 2024. 7.

Till filing of charge sheet, applicants to attend the concerned police station as and when called by investigating officer and shall co-operate in the investigation. [NITIN B. SURYAWANSHI, J.] Bhagyawant Punde
