Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The prosecution has a case that on 29.04.2022, the deceased disappeared. He did not find. Therefore, a missing report was lodged. On 02.05.2022, a decomposed dead body of the deceased was found. The prosecution has a story of last seen together through one witness, who appears to be on the WhatsApp group of the deceased. However, he gave his statement after about a month from the date of the incident. Besides this, recovery of the dagger (Khanjar) is the another circumstance against the accused. Considering the facts of the case and belated statement of the witness, last seen together

940-BA.97-23.odt appears to be not a substantial ground to reject the bail. The investigation has been completed. Nothing remained to be recovered from the applicant. In the above circumstances, the application deserves to be allowed. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SAINATH TATERAO PUYED be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.104 of 2022, registered by Police Station Mudkhed, District Nanded, for the offences punishable under Sections 302, 201 of the IPC, on the following conditions not to tamper with the prosecution witnesses, he shall attend the trial on each effective date.
