Mr.Biradar, learned Counsel for the petitioner, submits that the petitioner is an unemployed person, who has passed 10th standard examination, is desirous of starting a retail outlet. An advertisement was issued by the Respondent-Petroleum Company for the location "2 K.M. from Lodga from IOC Petrol Pump" The advertised place is situated within 1 KM from Lodga. Even the Talathi has given certificate to that effect. As the advertisement itself is wrong and wrong location is mentioned, the petitioner is apprehending that his application would be rejected on the ground that the location given is wrong. Mrs.Bajpai Dube, learned Counsel for RespondentCompany, submits that the location given in the advertisement is "at Lodga on State Highway 166 within 2 KM from IOC Petrol Pump

{2} wp183119.odt towards Latur". She submits that the location is rightly mentioned. It is submitted that the draw is also held and a candidate is also selected. The process of selection was as per the prescribed procedure.

We do not find that the location is wrongly mentioned in the advertisement. Even if we accept the contention of the learned Counsel for the petitioner that the location is at Lodga within 2 Kms from IOC Petrol Pump and assuming that the IOC petrol pump is within a distance of 1 KM from Lodga, the location cannot be described as wrong as the location is within 2 KM from IOC petrol pump.

Learned Counsel for the petitioner submits that on the earlier occasion in the year 2014, the location was wrongly shown in the advertisement. We are not concerned with the location shown in the advertisement issued in the year 2014 as the subject matter of the instant petition is the location shown under the impugned advertisement.

In the light of above, writ petition is disposed of. No costs.
