However, considering that the applicant is suffering from the disability and has suffered loss, this court is inclined to allow the application. Hence, the following order:

ORDER

a] The application is allowed.

b] The applicant is permitted to withdraw 50% of the amount deposited in the office of this court alongwith accrued interest on furnishing usual undertaking and further the applicant is allowed to withdraw 25% of the amount alongwith accrued interest on furnishing solvent surety/security to the satisfaction of the learned Members of the MACT, Beed. Remaining amount be kept in A fixed deposit in any nationalized bank to be renewed from time to time.

(3) c] The amount to be withdrawn be transferred to the court of MACT, Beed.
