Heard learned Counsel - Mr. Mehul P. Kulkarni holding for Mr. A.S. Sawant. None appears for the respondents despite service. 2.

The applicants are praying for condonation of delay of 287 days for preferring the appeal for enhancement of compensation. The applicants have preferred the First Appeal for enhancement of compensation. Learned Counsel for the applicants submits that, delay is caused because of the reasons stated in paragraph Nos.5, 6 and 7 of the application.

It is desirable to condone the delay. There are no malafides on the part of the applicants in preferring appeal. Due to the 1/2

950 CA 843-2025 circumstances narrated above he could not file appeal in time. I have gone through the contents of the application. There is nothing on record to controvert the same. The respondents have not caused any appearance despite due service. They did not contest the application. 4.

For the reasons stated in the application, Civil Application is allowed in terms of prayer clause 'B'.

Office shall register the First Appeal.
