1] On hearing the learned counsel for the petitioner, this Court was inclined to issue notice to the respondents.

2] The learned AGP submits that instead of keeping the Writ Petition pending, the appellate authority may be directed to decide Appeal No.354/2022 by maintaining stay to the order impugned before the Additional Divisional Commissioner, Aurangabad. 3] In view of the same, the Additional Divisional Commissioner, Aurangabad is directed to decide the Appeal No.354/2022, as expeditiously as possible, preferably within a period of 6 months. However, during pendency of the said Appeal, the order impugned before it passed by the Collector dated 30th August, 2022 would remain stayed.

605.23WP 4] In view of the above, the Writ Petition is disposed of.

5] The petitioner is directed to co-operate with the appeal and that the petitioner would not seek unnecessary adjournments in the matter. In the event, the petitioner is not prosecuting the appeal, the Commissioner would be at liberty to dismiss the same.
