Since the application for recalling the witness was filed on 14.03.2018 and the said application Exh.58 was allowed vide impugned order dated 01.10.2018, in Special Case No.19/2014, due to passage of time, the trial must have been proceeded further. He further submits that the instant petition has become infructuous. 2.

In view of the above, the instant petition stands dismissed, as become infructuous.
