Mr. Yogesh Bolkar learned counsel holding for Mr. R.B. Raghuwanshi, learned counsel for the respondent-sole submits, that he has no objection for the engagement of Mr. P. D. Patil as counsel for the respondent. The office objection as to the engagement of learned counsel Mr. P. D. Patil, therefore does not survive.

The matter in dispute, has been compromised by the parties. The compromise petition dated 06.04.2021 has been placed on record at Exhibit-A, along with Civil application No. 4749 of 2021. Under the directions of the Court dated 23.04.2021,

912-SA-533-1996.odt the Registrar (Judicial) of this Court was requested to verify and confirm the contents of the compromise and file a report. Accordingly, the Registrar (Judicial) has submitted a report dated 30.04.2021, wherein it has been stated, that the terms of the compromise application has been read over and explained to the parties, who have admitted the recitals and their signatures. 3.

In view of the above, the compromise as recorded in Exhibit-A is taken on record. There shall be a decree in terms of the compromise at Exhibit-A. The judgment and decree as passed by the learned trial court and the first appellate court, stand modified accordingly. Appeal is disposed of in terms of compromise. In view of disposal of appeal, pending civil applications are also disposed of.
