This Court has taken up the matter while dealing with the regular bail application of the accused. In the offence in question, which came to be registered under Section 376 of Indian Penal Code, the age of the victim was around fifteen years.

The accused in the case is a married person, whose bail is rejected by this application.

As a consequence of eloping of daughter of the complainant, the complainant and his wife, i.e. mother of victim have refused to take custody of victim.

In the circumstances, in my opinion, it will be appropriate to direct the investigating Officer to place copies of entire investigation papers of this case before the Court of learned Civil Judge, Senior Division, Ahmednagar, who himself or through any of his nominee is directed to mediate and try to convince the parents to take custody of the minor daughter, Priyanka.

Appropriate compliance report in the matter of action taken by learned Civil Judge, Senior Division, Ahmednagar be placed before this Court.
