Heard the learned advocate for the petitioner. 2.

The application filed by the petitioner for referring the document to hand writing expert is rejected. The attesting witness has denied the signature during the course of his evidence. The Trial Court has observed that, even the witness of the defendant has denied the signature on the document. However, the petitioner did not apply to send the signature of the defendant to hand writing expert. The petitioner has already examined attesting witness in his favour. The Court has given reasons for the same. The totality of the evidence will have to be considered by the Court while deciding the suit.
