BENCH AT AURANGABAD 919 WRIT PETITION NO.2175 OF 1997 M/S NEW SAGAR WINES & OTHERS.

VERSUS

THE STATE OF MAH. & OTHERS.

...

Advocate for Petitioner : Shri Godhamgaonkar A.G. AGP for Respondents 1 to 4 : Shri Bhagat N.T. ...

CORAM : RAVINDRA V. GHUGE, J.

Dated: February 14, 2019 ...

PER COURT :- 1.

The petitioners were aggrieved by the show cause notice dated 4.12.1996, issued by the Commissioner, State Excise, calling upon the petitioners to explain away the illegalities noticed with regard to illegal storage of country liquor at such places, which were beyond the scope of the license.

2.

Learned AGP points out that no interim relief was granted to the petitioners and subsequently the license has been cancelled. Learned AGP relies upon the affidavit-in-reply to support his contention that the license has been subsequently cancelled, since the petitioners could not putforth a proper explanation. Learned Advocate for the petitioners submits that in the event the license has been cancelled, a liberty may be granted to take recourse to remedies as may be permissible in law. akl/d
