The application is filed for bail. Both the sides are heard. This Court has perused the papers of investigation. 2.
The applicant is the mother in law of accused No. 1 - Parmeshwar. There was suspicion against deceased Shivaji, a person working with accused No. 1 that he had illicit relations with wife of Parmeshwar, who is daughter of present applicant. Cri. Appln. No. 245/15 3.
This Court has already considered the bail application of one Shri. Mane, against whom there are allegations that he was involved in making the evidence disappear. It appears that the other Hon'ble Judge of this Court has granted bail to Smt. Narsabai, who has similar role. There is no record whatsoever to show that at the relevant time, present applicant, who is resident of Hadolti, Tahsil Udgir, District Latur had visited the village Dongarshelke, Tahsil Udgir, District Latur. Prosecution will be relying on the statement of one Santosh, but his statement also does not show that present applicant was present in the house of applicant No. 1 on that night. 4.
In view of these circumstances, this Court holds that it is not desirable to keep the applicant behind bars till the disposal of the case. She is aged about 65 years and she has been behind bars since 18.12.2014.
5.
In the result, the application is allowed. The applicant is to be released on bail on her furnishing PR and SB of Rs. 15,000/- (Rupees fifteen thousand). She is not to tamper with the prosecution witnesses. She is not to commit similar offence. [ T.V. NALAWADE, J. ] ssc/
