The learned counsel for the petitioner submits that, application give by the petitioner for refund of the amount below Exhibit 329 in R. P. No. 31 of 2007 is not yet decided by the Recovery Officer, Debt Recovery Tribunal, Aurangabad, though more than two years have lapsed. The petitioner further seeks directions to the respondent No. 2 to refund the amount with interest within stipulated period.

It appears that, the application filed by the petitioner below Exhibit 329 is pending before the Recovery Officer. The recovery officer shall after hearing all the parties concerned decide the application of the petitioner for refund of amount on

2 wp 1493.22 its own merits, in accordance with law, expeditiously and preferably within a period of six (06) months from today. 3.

In the light of the above, the writ petition is disposed of. No costs.
