This petition takes exception to the order dated 13-082019, passed by the Joint Civil Judge, Junior Division, Shevgaon, below Exhibit-173 in R.C.S. No.25/2006, thereby rejecting the application of the petitioner to re-cast the issues.

Admittedly, recording of evidence is over and the matter is posted for final arguments. In that view of the matter, at this stage this Court is not inclined to entertain the present petition. The writ petition is, therefore, dismissed. All the contentions of the petitioners are kept open to be pressed in to service at appropriate stage. 3.

The amount of Rs.15,000/- deposited by the petitioners be refunded to them.
