Heard the learned counsel for the applicant, learned APP for the respondent-State and learned counsel for complainant.

The FIR reveals that there was a fight between the injured and the present applicant. The applicant also sustained the injury to his fingers. The injured and the applicant are relatives. They had quarrels. The injured has been discharged after five (5) days from his admission to the hospital. The charge sheet has been filed. The trial may take its time. Nothing is to be recovered from the applicant. There are no antecedents to his discredit. In the facts and circumstances of

32-BA.109-23+1.odt the case, the applicant deserves bail on certain conditions. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant YOGESH PRAKASH KANMOD be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.302 of 2022, registered by Police Station Bhokar, District Nanded, for the offences punishable under Sections 307, 324, 323, 506 read with Section 34 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall not enter the village for three (3) months from the date of his release.

(iii) Criminal application No.494 of 2023 to assist the learned APP is allowed.
