[I] Order in Civil Application :

This is an Application for bringing on record the legal representatives of the Sole - Petitioner.

Heard the learned Advocate for the Petitioner, learned Advocate for Respondent Nos.1 and 2 and the learned AGP for Respondent Nos.3 to 6.

The Petitioner was in the services of Respondent No.2 - School, run by Respondent No.1. The Petitioner was seeking pension. He was referred for medical examination. According to the learned Advocate for the Petitioner, the cause survives since the relief in the Petition was in respect of the pensionary benefits. Therefore, the Application be allowed.

The learned Advocate for Respondent Nos.1 and 2 - Management opposes the Application. He submits that, since the Petitioner was found medically fit, he would not be entitled for the invalid pension and, therefore, nothing survives in the Petition. 5.

It would be the question of merit whether the Applicants would be entitled for the said pension. After considering the submission of both the sides, we allow the Application in terms of Prayer Clauses - (A), (B) and (C). Amendment be carried out within a period of one (01) week.

Application is disposed off accordingly.
