Learned counsel for the respondents states that the petitioner did not comply with his undertaking to deposit the money. This Court has already declined to grant any type of protection.

Hence, list the matter for hearing on 12.06.2024. 3.

The petitioner has deposited Rs.4,00,000/- with this Court against the recovery of loan. The respondent is a Cooperative bank. Therefore, there is no harm to the petitioner if they are allowed to withdraw the money.

Civil application is allowed.

The Office to release Rs.4,00,000/- (Rupees Four Lacs) deposited with this Court with interest if any on the undertaking that he would deposit the money, if the impugned judgment and award is reversed.

It is clarified that there shall be no extension of time to deposit the money as directed.
