Heard learned Counsel for applicants and learned A.G.P. for respondent - State.

Learned Counsel for applicants submits that, appellant Shivhar Sidhappa Chille is died during the pendency of appeal hence, the appeal is disposed of. The legal heirs of the deceased are necessary to be taken on record. Though the appeal is disposed of there is delay for filing this application, hence reuuested to condone the Pooja K.

Considering the submissions of both the learned Counsel as well as reasons mentioned in the application, application is allowed in terms of prayer clauses '2' and '3'.
