The contention is that the competent authority first conducted a proceeding with regard to the purported unauthorized sand. Now, one more notice is issued on ---/12/2023, for the purposes of imposing penalty on the offending vehicle.

Since the show cause issued by the Sub Divisional Officer is directly assailed in this Court, this Petition is disposed off with liberty to the Petitioner to take all the grounds before the concerned authority by tendering a written reply to the show cause notice. If advised, an application for release of the vehicle will also be made by way of an interim measure.

If such an application is filed, the S.D.O., Chalisgaon would deal with such application and pass an order within 15 days by dealing with all the contentions of the petitioner.
