Mr. Garud, the learned Advocate for the petitioner informed that the Regular Civil Suit No. 525/2017, out of which the present petition arises, itself is dismissed by the learned 14th Joint Civil Judge, Senior Division, Ahmednagar by judgment and order dated 7th July 2022. Both the learned Advocates therefore submit that present petition has become infructuous. The copy of judgment and order dated 7th July 2022 passed in RCS No. 525/2017 is taken on record and marked "X" for identification purpose.

In view of above, petition stands disposed off as infructuous. 3.

Needless to say that the appeal which is reportedly pending will be decided on its own merit.
