PER COURT :- The proposal tendered by the institution, seeking approval to the appointment of the petitioner has been sent back by the Assistant Commissioner - Social Welfare, Jalgaon by order dated 28.4.2015. The petitioner belongs to Scheduled Caste (SC) category. As such, the policy, prescribing accommodation of surplus candidates is not attracted in his case.

In this view of the matter, respondent Nos.3 & 4 deserve to be directed to reconsider the proposal of the institution, seeking approval to the appointment of the petitioner on its own merits. It would be open for the institution to tender the proposal to respondent Nos.3 and 4 within a period of four weeks from today. If such proposal is tendered by the institution, the concerned respondent shall consider the same and take appropriate decision, on consideration of merits of the proposal, as expeditiously as possible and preferably within four months from the date of its' receipt.
