Learned counsel for the applicant states that the parties have amicably resolved the dispute between themselves, and, in the circumstances, it would be a facility, if the proceedings at Mumbai are transferred to a competent court at Ahmednagar. 2.

There is no appearance caused on behalf of the respondent. The aforesaid submissions, therefore, go controverted. 3.

In the circumstances, it would be expedient that the request is granted. As such, miscellaneous civil application is allowed in terms of prayer clause (B) and is disposed of. [SUNIL P. DESHMUKH] JUDGE arp/
