The petitioner is claiming that the petitioner belongs to 'Koli Mahadev' scheduled tribe and thus had been seeking relief and concession in respect of usual course fees required for the education. The petitioner has been prosecuting her studies. Her tribe claim has been pending with Scrutiny Committee. There had been insistence by respondent No.3 for payment of course fees. This Court under order dated 19.01.2017 had refrained respondent No.3 from insisting upon fees from the petitioner as an open category candidate subject to filing an undertaking that if her claim is invalidated, the petitioner would pay entire fee as required and accordingly it appears an undertaking has been filed.

Subsequently, learned AGP submits that tribe claim of the petitioner had been decided and rejected. 3.

In view of aforesaid, it is difficult to grant request made in the petition. The petition is thus rejected and disposed of. Learned counsel for the petitioner, however, submits that decision of Scrutiny Committee could be challenged. If challenge to the decision of Scrutiny Committee would be posed, in such a case this order for said purpose would not be an impediment.
