Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with Crime No.522/2024, dated 19.08.2024, registered at City Police Station, Taluka Nandurbar, District Nandurbar, for the offences punishable under Sections 191(3), 191(2), 189(2), 118(1), 115(2), 109, 37(1) of the Bhartiya Nyaya Sanhita, 2023 & Section 135 of the Maharashtra (Bombay) Police Act, 1951 [Section 148, 147, 142, 324, 323, 307, 99 of the IPC].

The allegations against the applicant is that, the two groups had met at the temple for resolution of dispute between them. Thereafter,

2 908 one person using wooden stick assaulted the deceased Vishnu Gavit by hitting on his head. At that time, some persons tried to intervene and tried to separate them and resolve the dispute. However, they were assaulted by the applicant along with others. There are statements of eye witnesses Mr. Shantilal and Mr. Vinayak to that effect. 4.

The applicant is, prima facie, involved in the crime, which is evident from the statements of the witnesses. 5.

In view of the above, this is not the fit case for grant of anticipatory bail.
