We have perused the e-mail order dated 17.11.2023 by which the Bharat Petroleum Corporation Limited (Company) has intimated the Petitioner, the ground on which the application for seeking a RO dealership, has been rejected. In Clause 4 of the e-mail, the Petitioner is given an option of tendering an application from the date of the said letter.

As such, the Petitioner was expected to tender her application on or before 27.11.2023.

The learned Advocate for the Petitioner draws our attention to the application dated 24.11.2023 and submits that it is in deference to Clause 4 of the e-mail dated 17.11.2023. However, there is no acknowledgment stamp on the said application. We granted a pass over to the learned Advocate.

After lunch, the learned Advocate has tendered a 4 pages compilation, which is taken on record and marked collectively as 'X-1' for identification. The first page indicates the speed post receipt by which the Petitioner tendered her application to the Company, which is within limitation.

In view of the above, we do not find that we should issue a Writ of Mandamus to the Company within such a short period of time. The Company has to be given some time to take a call on such application.

In view of the above, this Petition is disposed off expecting the Company to take an early decision.
