3 Application 57/2015 group ORDER:
1) All the applications are filed for the relief of bail. Both the sides are heard. This Court has perused papers of investigation.
2) Crime is registered on the basis of report given by one Sagar Digamber. Allegations are made that in one incident dated 20-11-2014 after 6.00 p.m. he, his father and brother were returning with cash in hand of the shop and they were intercepted by six persons. Allegations are made that one Sagar Rajendra Misal snatched the gold chain and when his brother was opposing beating was given to him. Allegations are made that, Ramesh Amolik, Jayesh Amolik Ravindra Patole, Sagar Shilwant and Girish Paranjape were also with him. Hand bag of black colour of the complainant was tried to be snatched by Jayesh Amolik and Ramesh Amolik. Allegations are made that they were giving severe beating to the complainant by using wooden logs. Crime was registered for offences punishable under sections 395, 341, 325 etc. of Indian Penal Code.
4 Application 57/2015 group 3) Learned counsel for the applicants submits that prior to this incident, one incident took place on 20-112014 but subsequently on 22-11-2014 report was given by the side of the accused and crime came to be registered for offences punishable under sections 143, 147, 323, 504, 506, 34 of Indian Penal Code and section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act. Copy of F.I.R. is produced on record. 4) The submissions made show that there is political rivalry between the parties and allegations are made. The learned counsels submit that the applicants came to be arrested on 21-11-2014 and since then they are behind the bars. In view of nature of allegations it can be said that police should not feel it hurdle in the investigation if bail is granted to the applicants. The applicants-accused are known to the complainant and the witnesses. In view of these circumstance it is not desirable to keep the applicant behind the bars till disposal the case.
5 Application 57/2015 group 5) In the result, the applications are allowed. The applicants are to be released on bail in Crime No. I282/2014 registered in Shrirampur City Police Station, District Ahmednagar for offences punishable under sections 395, 325, 341 of the Indian Penal Code on their furnishing PR and SB of Rs.15,000/- by each of the applicants. The applicants are not to tamper with prosecution witnesses. They are not to commit similar offences.
