Heard learned Counsel for applicants, learned A.G.P. for respondent Nos.1 and 2 and learned Counsel for respondent No.3.

Learned Counsel for applicants submits that, in connected group of matters (Coram : Shrikant D. Kulkarni, J.) has permitted the applicant to withdraw 75% of the amount of compensation deposited by the acquiring body / respondent No.3 with accrued interest thereon on furnishing Pooja K.

{2} 949-CA-1989-2022 usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court. Hence, requested to pass same order and allow the application.

Considering the submissions of all learned Counsel as well as considering the order passed by this Court (Coram : Shrikant D. Kulkarni, J.). Hence, I pass the following order :-

ORDER

(a) Application is allowed.

(b) Applicants are permitted to withdraw 75% of the amount of compensation deposited by the acquiring body/ respondent No.3 with accrued interest thereon on furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court. (c) Remaining 25% of the amount of compensation with accrued interest thereon shall be invested in the Fixed Deposit with any Nationalized Bank initially for a period of two years with clause of renewal. (d) The Civil Application is disposed of.
