The learned Advocate for the petitioner clarifies that though prayer clause B may indicate a different meaning, the petitioner has two Primary and Secondary Ashram Schools at Sangli and Solapur. Considering the rules that such a school could be migrated only within 10 kms of the place at which it is presently situated, he prays that the proposal dated 29.03.2022 be considered strictly in accordance with the Rules and only for migration within the periphery of 10 kms from Sangli and Solapur, respectively.

In view of the above, this petition is disposed off. Needless to state, the petitioner's proposal for transfer of the said school beyond the limits of 10 kms, shall be rejected. If the proposal indicates a request for migration within the periphery of 10 kms from Sangli and Solapur, respectively, the said proposal would be considered by respondent No.1, on or before 30.04.2023. Needless to state, we have not expressed any opinion as regards the claim of the petitioner and it is left entirely to the competent authorities to decide the said claim in accordance with the Rules and any order passed by this Court, if applicable.
