Learned Counsel Mr. Tawashikar invited our attention to the order passed by this Division Bench in Writ Petition No. 12387/2017 dated 9th January, 2018. The learned Counsel submits that petitioner is similarly situated with the petitioner in Writ Petition No. 12387/2017. The learned Counsel Mr. Tawashikar as well as learned Counsel Mr. Deshpande admit that the petitioner has already approached the Arbitrator and the said proceedings are pending before the Arbitrator. In view of this fact, we see no reason to take a different view than the view adopted by the
