After hearing the parties at length, learned counsel for the respondent - Zilla Parishad came around to submit that if the petitioner submits an application to the Chief Executive Officer, Zilla Parishad, with a list of the incomplete works, the Chief Executive Officer would take a decision as regards getting the said work done from the petitioner, within a reasonable time.

We hope that the Chief Executive Officer would consider the case sympathetically, based on the rules and regulations, if any;

5-wp901.2024 and get the work done from the petitioner himself, so as to avoid excess expenditure, time, etc. The Chief Executive Officer would also consider the additional affidavit tendered across the bar by the petitioner, copies of which are given to other side. The Chief Executive Officer is expected to take a decision within four weeks from the date of receipt of a copy of this order. The period of contract shall necessarily get extended to the extent the time spent in this litigation.

With the above directions, the petition stands disposed of. All the Pending Civil Applications also stand disposed of. 5.

We make it clear that imposition of costs by this Court vide Court dated 01.03.2024, shall not be considered as an obstacle in the career progression of the concerned Officer of the Zilla Parishad.
