Special Land Acquisition Officer v. Shakuntalabai Vishwasrao
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD FIRST APPEAL NO. 686 OF 2003 SPECIAL LAND ACQUISITION OFFICER
VERSUS
SHAKUNTALABAI VISHWASRAO ...
CORAM:
VIMALNATH S. TIWARI REGISTRAR (JUDL) DATED: 31/01/2023 1.
This First Appeal was to be listed on today'
s board.
However, inadvertently the office has not taken this First Appeal on today'
s Board and hence, the said First Appeal is taken on board today.
2.
The present First Appeal is filed by the State. As per the earlier order dated 03/01/2023, this Court has granted four weeks time to furnish fresh address of respondent no. 1 to 3. 2.
Today, the representative of Government Pleader' s Office for the State submits that, four weeks granted earlier is ending today and therefore, has requested four more weeks time to furnish fresh address of respondent no. 1 to 3. In view of the FIRST APPEAL NO. 686 OF 2003
submission made herein, instead of passing any stringent order outrightly, I am of the considered view that in the interest of natural justice, one more opportunity needs to be granted, which opportunity cannot be without any condition and hence I pass following order.
ORDER
Two more weeks time is granted to the State to take necessary steps for furnishing address of respondent Nos. 1 to 3. It is also made clear that on failure on the part of appellant/State to furnish fresh address of respondent no. 1 to 3 within period of two weeks from today, in that event, the said First Appeal would stand abated against respondent nos. 1 to 3, as provided in Rule 6(2) of Chapter VII of the Bombay High Court Appellate Side Rules, 1960.
