PER COURT :
1) The applicants, driver and cleaner of the commercial transport vehicle, who were arrested in Crime No.1/2017 registered at Waluj Police Station, District Aurangabad for the offences punishable under Sections 379 of Indian Penal Code and under Section 21(4) of the Mines and Mineral Regulation Act, 1957, are seeking regular bail.
2) The applicants were subjected to custodial interrogation. There are no criminal
Cri.Appln.No.302/2017 antecedents qua the alleged crime under the Mines and Mineral Regulation Act, as stated by the learned Counsel for the applicants.
3) Looking to the nature of the allegation against the applicants that they were transporting the sand, they are entitled to be released on bail.
4) The applicants be released on bail in Crime No.1/2017 registered at Waluj Police Station, Tq. Gangapur, District Aurangabad for the offences punishable under Sections 379 of Indian Penal Code and under Section 21(4) of the Mines and Mineral Regulation Act, 1957, upon furnishing PR bond of Rs.15,000/- each with one or two sureties in the like amount.
5) The applicants shall not influence the prosecution witnesses and shall not tamper with the prosecution evidence.
6) The Criminal Application stands allowed accordingly.
