Mr. Naiknaware, the learned counsel for the petitioners submits that the petitioners have filed applications for enhancement of compensation before the Arbitrator. The same are rejected. The evidence has not been considered by the Arbitrator. The petitioners have also filed applications to lead additional evidence. The same are also not considered.

The petitioners had approached the Arbitrator seeking enhancement of compensation awarded to the petitioners as per the award passed under Section 3 G (1) of the National Highway Act. If the petitioners are aggrieved by the award passed by the Arbitrator, the petitioners have remedy under Section 34 of the Arbitration and Conciliation Act.
