Shinde, A.G.P. for the respondent/State Smt. Kalpalata Patil-Bharaswadkar, Advocate for respondent No. 2 ---- CORAM :

T.V. NALAWADE AND SANGITRAO S. PATIL, JJ.

DATE : 20th JUNE, 2017 PER COURT :

Heard the learned counsel for both sides.

2.

We have gone through the reliefs claimed in this petition. The appointment on compassionate ground was sought in the proceeding i.e. Original Application No.179/1993, filed by the petitioner before the Maharashtra Administrative Tribunal ("Tribunal", for short). At the relevant time, the age of the petitioner was 22 years. When the present petition was filed in the year 2004, the petitioner was 33 years of age. He must have thus crossed the age of 45 years at present. In view of this circumstance, no relief can be granted in favour of the petitioner as claimed in the petition.

wp1246-2004 Even on merits, we are not inclined to interfere with the order dated 29th January, 2004, passed by the Tribunal. In the result, the Writ Petition is dismissed. [SANGITRAO S. PATIL] [T.V. NALAWADE] JUDGE JUDGE npj/wp1246-2004
