It is being pointed out that in fact, there are 13 places where the District Level Committees are still to be established for want of willingness from the retired Principal District and Sessions Judges, though erroneously the order mentions about five such places. Even it is being pointed out that there is some error in mentioning the names of places.

In paragraph 7 of the order dated 07.02.2025, the word 'five' be replaced by the word 'thirteen' and the names of districts shall be modified as under :- "1) Nashik, 2) Jalna, 3) Pune, 4) Ahmednagar, 5) Dhule, 6) Jalna, 7) Beed, 8) Amravati, 9) Akola, 10) Wardha, 11) Gondia,
12) Gadchiroli and 13) Washim"

The order be, accordingly, corrected and uploaded. The motion is disposed of.

DATE : 07th February, 2025 Per Court :- By way of this Civil Application, the Project Director of Samagra Shiksha Office, Maharashtra Prathamik Shikshan Parishad, Mumbai, Jawahar Bal-Bhavan, Netaji Subhash Road, Maharashtra-400004, has been sought to be added as respondent No.12.

The Civil Application is allowed. Amendment be

Issue notice to respondent No.12 being added, returnable on 26.03.2025.

Respondent No.12 Project Officer is directed for the time being to assist the State Level Committee as and when called upon by it.

Pursuant to the directions contained in paragraph 7 of the order dated 20.09.2024, the learned Government Pleader tenders across the bar a copy of Government Resolution dated 29.10.2024 for composition of the State Level Committee and the names of individual members as also amenities available to the Committee and its members. The parties are ad idem that pursuant to earlier directions as regards the staff is concerned, it would be responsibility of the Director of Education (Primary), Maharashtra State,Pune, who is convener, to make available staff for the assistance of the State Level Committee. 6.
In respect of the directions contained in paragraph 6 of the order dated 20.09.2024, the learned Government Pleader submits that he has received information that has to be collated
*5* and an affidavit in reply is to be filed, but it will take sometime and assures of filing such affidavit in reply by the next date. 7.
It is being pointed out that an attempt has been made for composition of the District Level Committees pursuant to the earlier orders. Except at thirteen places, the District Level Committees could be established. For want of willingness from the retired Principal District and Sessions Judges at 1) Nashik,
2) Jalna, 3) Pune, 4) Ahmednagar, 5) Dhule, 6) Jalna, 7) Beed, 8) Amravati, 9) Akola, 10) Wardha, 11) Gondia, 12) Gadchiroli and
13) Washim, the Committees could not be constituted at those places.

In the light of the directions contained in the order dated 20.09.2024, the Principal District Judges from these places may continue to explore availability of services of retired Principal District and Sessions Judges. However, by way of interim measure and direction, the Collector of the concerned district, for the time being, shall chair the District Level Committee at these places and shall discharge the function as has been indicated and directed in the earlier orders and report compliance to the State Level Committee.

All District Level Committees shall now prepare a report regarding infrastructure and its condition in respect of the schools being run by the local authorities/ bodies and submit such reports to the State Level Committee within six weeks. 10.
Once such reports are prepared and submitted by the District Level Committees to the State Level Committee, we request the State Level Committee to undertake an exercise of comparing information uploaded on the UDISE with the reports of the District Level Committees. If the State Level Committee forms an opinion and has some suggestions after such comparison, let those be informed to the Court in an objective manner.
