The learned Additional Public Prosecutor has tendered across the bar affidavit in reply of Respondent no.2. Respondent No.2 has verified about the genuineness of the death of Hemraj Fulchand Varma and it is stated in the affidavit that, the said certificate is genuine. The wife of said Hemraj Varma also stated before the Investigating Officer that, Hemraj is no more. It is also stated in the affidavit in reply that, N.C. Final 2 of 2014 is submitted before the learned Judicial Magistrate, First Class, Aurangabad.

In that view of the matter, nothing can be survived for consideration in the application. The application stands disposed of.
