Learned counsel for the petitioner, on instructions, seeks leave to withdraw this writ petition with liberty to the petitioner to file an application for withdrawal of the suit on the same cause of action.

Leave granted. The writ petition is disposed off as withdrawn. The petitioner is always at liberty to file an application in respect of the pending suit and it is for the trial Court to pass an appropriate order in accordance with law. 3.

In view of withdrawal of writ petition no. 190 of 2017, nothing survives in writ petition no.9805 of 2017 and the same is also disposed off.
