The learned Advocate for the Petitioner submits that the Petitioner is a retired Judicial Officer. He has moved representations to Respondent No.2/Chief Officer, Municipal Council, Partur, pointing out that, some persons have indulged in encroachment on the open space that belongs to their private colony. He submits that, directions may be issued to the Chief Officer, Municipal Council, Partur, to resolve this problem. If the said Authority is unable to resolve the said problem, the Petitioner would approach the Civil Court, by filing a civil suit.

In view of the above, this Writ Petition is disposed off. Let Respondent No.2/Chief Officer, Municipal Council, Partur, take a call on the said representations of the Petitioner and initiate appropriate action. If the grievance of the Petitioner is not redressed, he would be at liberty to approach the Civil Court/Cooperative Court, by preferring an appropriate proceeding. (Y. G. KHOBRAGADE, J.) (RAVINDRA V.
