Parties to the appeal have arrived at amicable settlement and placed on record terms of the compromise, which are duly verified before the Section Officer and marked as Exhibit-X for identification. After filing of the terms of settlement, parties were relegated to the Registrar (Judicial) of this Court, who verified contents of the compromise terms and parties and submitted his report dated 10.3.2025 that parties have amicably settled the dispute and they have voluntarily signed the terms of settlement. Report of the learned Registrar (Judicial) is marked as Exhibit-Y for identification. It appears that the appellant Taramati has admitted Omprakash to be legally adopted son and absolute owner and possessor of the suit properties. Further, she is paid an amount of Rs.30 Lakh

sa 236.2011.odt by demand draft. Receipt of which is acknowledged by her in terms of compromise. Respondent no.2 in appeal has been deleted, however, his interest is protected in the terms of the compromise. He being purchaser from Ompakash, his rights are secured.

Taking into account terms of the settlement as verified by the parties and approved before the Registrar (J) of this Court, Second appeal stands disposed of in terms of the compromise. Decree under appeal be modified in terms of compromise. Second appeal stands disposed of in aforesaid terms. Civil application, if any, also stands disposed of. ( S. G. CHAPALGAONKAR, J. ) ...
