We have disposed of earlier writ petition filed by the petitioner under judgment and order dated 06.11.2019 and directed the Education Officer to consider the proposal seeking approval to the transfer of the petitioner from unaided to aided division afresh in light of the decision given in Writ Petition No.1493 of 2018 with connected writ petitions dated 04.07.2019.

It appears that while passing impugned order the Education Officer has failed to consider the said judgment. The non-consideration of the the judgment dated 04.07.2019 in Writ Petition No.1493 of 2018 amounts to sitting over the judgment passed by this Court and inviting action for contempt.

We expect the Education Officer to go through the judgment delivered by us and abide by the directions issued by us.

The petitioners shall give the copy of the judgment and order dated 04.07.2019 in Writ Petition No.1493 of 2018 to the concerned Education Officer.

The impugned order is quashed and set aside.

6.

The Education Officer shall decide the proposal seeking approval to the transfer of the

(3) petitioners from unaided to aided division strictly in tune with the judgment of this Court dated 04.07.2019 in Writ Petition No.1493 of 2018 with connected writ petitions within a period of four

(04) months.

7.

Writ petitions are disposed of. No costs.
