PER COURT :- 1.

The petitioners are aggrieved by the order dated 6.12.2016, passed by the appellate Court, thereby staying the decree dated 19.10.2015, delivered by the trial Court in RCS No.16 of 2004. 2.

Though the learned Advocate for the petitioner has strenuously canvassed the ten grounds formulated by him in this petition and has indicated that the appeal Court should not have stayed the decree, I find that the ends of justice would be met if the appellate Court is directed to decide the pending appeal of 2015 expeditiously. 3.

Considering the above, this petition is disposed off with a direction to the appellate Court to decide RCA No. 48 of 2015 on it's own merits, on/or before 15.1.2018.
