PER COURT :- The petitioner who is disqualified as a Sarpanch is aggrieved by refusal of the appellate authority to stay the order of disqualification passed by the Collector.

I am not inclined to make decisive observations on merits lest the petitioner or the complainant is prejudiced. The order impugned needs no interference considering that the allegation is that the encroachment is on a public road. The order impugned is maintained.

However, the learned Commissioner shall dispose of the appeal finally as expeditiously as possible and in any event within 30 days. The petition is dismissed .
