It appears that the exercise undertaken by respondents was under impression that the petitioner has applied for higher pay scale, however, it appears that the petitioner has applied for the pay scale as admissible to the teachers in Junior College. Learned Counsel invited our attention to the qualifications for teachers in junior colleges in Schedule of M.E.P.S.
Rules, 1981, and submits that the petitioner possesses the requisite qualifications.

Respondent no.3 has filed affidavit in reply and in paragraph no.3 of the affidavit in reply, it is stated that the matter requires reconsideration and, therefore, the respondents will reconsider the proposal of the petitioner afresh. AGP/-

In the light of the above, we set aside the impugned communication dated 3rd October, 2013, issued by the Deputy Director of Education, Nashik Region, Nashik. We direct respondent no.2 to decide the proposal of the petitioner as expeditiously as possible, preferably, on or before 15th June, 2015. Petition is disposed of in above terms.
