Heard the learned counsel for the applicant and the learned counsel for the respondent-insurer. The learned counsel for the respondent-insurer submits that the challenge is made to the judgment and award passed by the tribunal to the extent of quantum. In view of the above, the applicant-claimant is permitted to withdraw 50% of the amount deposited before this court. The learned counsel at this stage submits that both the legs of the applicant below knee are amputated on account of the injuries sustained by her in the accident and, therefore, she is not in a position to come at Aurangabad and withdraw the compensation amount.

In view of the above submissions, the aforesaid withdrawal of 50% amount is permitted and the same shall be transferred to the M.A.C.T. Shrirampur, Dist. Ahmednagar. The
961 ca 1712.17.odt applicant shall submit an undertaking to the satisfaction of the registrar of the said Court and withdraw the amount as directed. Civil application is accordingly disposed of. 3.
Fix the matter for final disposal on 02.03.2017 in urgent category.
