The learned counsel for the petitioner submits that, the validation proceeding is pending.

Mr Shinde, learned Assistant Government Pleader accepts that the validation proceeding is pending, however, the petitioner has not filed say to the vigilance report.

According to the learned counsel for the petitioner, the petitioner has filed say to the vigilance report on 06.12.2016. 4.

Considering the fact that the validation proceeding is pending, we pass the following order.

ORDER

(i) The Committee shall decide the tribe claim in respect of the petitioner expeditiously, preferably within a period of six months from the date of appearance of the petitioner. (ii) The petitioner shall appear before the Committee on 21.03.2018.

(iii) The petitioner shall cooperate in expeditious disposal of the proceeding.

(iv) The respondent-employer shall not take adverse action against the petitioner only on the ground that the validation proceeding is pending.

(v) The respondent-employer can take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding.
