The vehicle of the petitioners has been seized and penalty is imposed on the ground of illegal excavation and transportation of the sand purportedly, referring to Section 47 and 48 of the Maharashtra Land Revenue Code.

The petitioners have filed the appeal. The grievance of the petitioners is that the petitioners have filed application for release of the vehicle. The same is not entertained.

It is submitted that the appeal is pending since 6th November, 2020 with respondent No. 3.

We have heard the learned Assistant Government Pleader for the respondents.

In case the appeal filed by the petitioners is pending with respondent No. 3, then respondent No. 3 shall decide the said appeal finally within a period of six weeks from today. 6.
