CORAM: R.M. BORDE AND A.I.S. CHEEMA, JJ.
DATE : 8TH JANUARY, 2016 ORDER :
1.
The Petitioner is objecting to the order passed by the Scrutiny Committee directing invalidation of caste certificate issued in his favour. It is the case of the Petitioner that he belongs to "Pardeshi Bhamta", which is included in
Vimukta Jati category. Since the Petitioner secured employment as against reserved seat, the caste certificate issued in his favour was referred to the Scrutiny Committee for verification.
2.
The Petitioner, in order to substantiate his claim, has placed reliance mainly on the school record, wherein the entry in respect of his caste is recorded as "Hindu Pardeshi". The entry in respect of the caste in the school record of the son of the Petitioner was recorded as "Pardeshi Bhamta", but the same is of recent origin i.e. 13th June 1989. The caste certificates issued in favour of cousin, grand father and father of the Petitioner by the Executive Magistrate do not have any probative value. There is absolutely no evidence produced by the Petitioner so as to draw conclusion in respect of his caste status as belonging to Vimukta Jati category.
3.
On perusal of the order passed by the Scrutiny Committee, we do not notice any irregularity or inconsistency in the said order. The Petition is devoid of substance. The Writ Petition is rejected.
