Learned Advocate for applicant has mentioned the matter for modification of order passed by this court on 17.12.2020.

Perusal of the order passed by this Court would show that a statement was made by learned Advocate representing the applicants that applicant N.1 is ready to return the ornaments to the informant. On the basis of the said statement, applicant No.1 was directed to hand over the articles of gold as well as silver mentioned in the FIR before the Nazir attached to other the Court of JMFC, Bhokar, District Nanded.

Now, the learned Advocate for the applicants is submitting that applicant No.1 is ready to handover the gold articles. However, it is stated that no silver articles have been received by applicant No.1. It is to be noted that the aforesaid statement was made by the learned advocate representing the applicants that they will return return the ornaments to the informant and based on the said statement, the said order came to be passed. Now, they cannot change their stand. The application for modification stands rejected.
