None appears on behalf of the petitioner. Heard the learned Addl. Government Pleader appearing on behalf of respondent nos.01 to 03.

It appears that the petitioner is not keen in pursuing the petition. The petitioner is claiming pension of his father who died on 11.10.1953. 03.

Two replies have been filed by the State. It is stated that the necessary documents have not been received by respondent no.03 from respondent no.01. During pendency of the petition, petitioner has died and heirs of the petitioner have not been brought on record. In second reply in para 04, it is stated that the legal heirs of the deceased pensioner obtained orders from the sanctioning authority. The District Treasury Office, Parbhani, has no objection to pay the lifetime arrears of family pension of the deceased employee.

Preserving right of the grand-children of the deceased employee / pensioner, the Writ Petition is disposed of. Rule discharged. There shall be no order as to costs.
