The learned counsel for the petitioner submits that validation proceeding in respect of the tribe claim of the petitioner is pending with Scrutiny Committee. The same is yet not decided. The employer is asking for the tribe validity certificate. 2.

The learned Addl. Govt. Pleader accepts notice for Respondent Nos.1 and 2 and submits that the validation proceeding of the petitioner with the Committee is pending for final hearing and is fixed on 03.03.2021.

The petitioner shall remain present before the Committee on 03.03.2021 and advance the arguments.

The Committee shall thereafter decide the proposal, preferably within a period of two months.

The employer shall not take adverse action against the petitioner only on the ground that validation proceeding is pending. The employer can take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceedings.

Writ petition is disposed of. No costs.
